Ohana Luxe Events Ltd– Terms and Conditions of Hire
All goods supplied are on a hire basis only and title remains with Ohana Luxe Events Ltd. Hereafter known as the Hiree.
The Hirer is the person named on the booking form. The Hirer takes full responsibility for the goods under these terms and conditions.
1. Booking & Confirmation
A booking is confirmed only once a signed agreement or email confirmation has been received and a non-refundable booking fee of 50% of the total quoted fee has been received. Ohana Luxe Events Ltd will not hold dates or commence services until payment is made.
2. Fees & Payment Terms
The remaining balance is due no later than 4 weeks prior to the event date, unless otherwise agreed in writing. Failure to pay the balance by the due date may result in cancellation of services without refund of any amounts paid.
Ohana Luxe Events Ltd reserves the right to invoice for any outstanding amounts owed under this clause.
All prices are quoted in writing and are valid for 14 days from the date of issue unless stated otherwise.
Please note all prices are subject to VAT (if applicable) and it will be applied on confirmation from the Hirer.
3. Non-Refundable Booking Fee
The booking fee is strictly non-refundable under all circumstances. This fee covers administrative time, planning, and reservation of the event date.
4. Client Cancellation
If the Client cancels the event for any reason, the following cancellation fees apply:

Cancellations made more than 30 days prior to the event: The booking fee is non-refundable. If the full balance has already been paid, 50% of the total amount paid (excluding the booking fee) will be refunded to the client
5. Rescheduling
Rescheduling requests must be made in writing and are subject to availability. Payments may be transferred to a new date once only, provided the new date is within 6 months of the original event date. Additional costs may apply. Ohana Luxe Events Ltd does not guarantee availability for rescheduled dates.
6. Changes to Services
Any changes to the agreed services must be requested in writing and may result in additional charges. Ohana Luxe Events Ltd is not obligated to accommodate last-minute changes.
7. Client Responsibilities
The Client is responsible for providing accurate event details, securing venue access, permits, and approvals where required. Ohana Luxe Events Ltd is not liable for delays or issues caused by incomplete or incorrect information provided by the Client.
The Hirer will pay for any non-returns, damaged goods or breakages to the Hiree at the full retail price of particular goods.
The Hirer shall be solely responsible for the hired goods not the reception at the location of the event, venue, hotel, florist or any other third party to whom shall take possession of the hired goods. The Hirer shall be solely responsible for ensuring that the hired goods are kept in good order, from the time of the receipt of delivery until returned back to the possession of the Hiree.
Where it has been agreed, based on the selected package, that onsite staff are not required, the hirer is solely responsible for communicating with the hiree regarding any changes to collection times.
8. Force Majeure
Ohana Luxe Events Ltd shall not be held liable for failure to perform services due to circumstances beyond reasonable control, including but not limited to acts of God, government restrictions, extreme weather, illness, or supplier failure. In such cases, no refunds will be issued, but reasonable efforts will be made to reschedule where possible.
9. Cancellation by Ohana Events
In the unlikely event that Ohana Luxe Events Ltd must cancel the event due to unforeseen circumstances, all payments received will be refunded in full. This refund shall be the Client’s sole remedy, and no further liability will be accepted.
10. Limitation of Liability
Ohana Luxe Events Ltd liability is limited to the total amount paid by the Client. Ohana Luxe Events Ltd shall not be liable for indirect, consequential, or emotional distress claims.
11. Intellectual Property
Ohana Luxe Events Ltd retains the right to use photographs, videos, and descriptions of the event for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
12. Acceptance of Terms
By paying the booking fee, the Client confirms they have read, understood, and agreed to these Terms & Conditions in full.
